Introduction

At Virtuaal, we are committed to delivering exceptional services to our clients. We understand the importance of clear and transparent policies when it comes to cancellations and refunds. This Refund & Cancellation Policy governs the conditions under which our clients can request cancellations and refunds, ensuring fairness and accountability for both parties involved. By accessing or using our services, the customer acknowledges and agrees to these terms as part of their contractual relationship with Siri Associates, an Indian company headquartered at 3-9-639/71, Anithanagar, Mansoorabad, Hyderabad, India – 500068 (referred to as the “Company”).

If you are acting on behalf of a corporate entity or another third party, you represent and warrant that you possess the necessary authority to bind that corporate entity or third party to these terms.

1. Cancellation Policy

The Company reserves the right to suspend, deny, or terminate access to its services and platform, including the closure of an Ad Account, for any reason, including but not limited to the following situations:

1.1. Material Breach

If the customer or any additional user associated with the customer violates any of the terms, representations, or warranties agreed upon during the contractual engagement, the Company will provide written notice specifying the breach. The customer will have a period of ten (10) calendar days to rectify the issue. Failure to remedy the breach within this period may result in the immediate suspension or termination of access to the service without further notice.

1.2. Bankruptcy or Insolvency

In the event that bankruptcy, insolvency, or debt relief proceedings are initiated by or against the customer, the Company may immediately suspend services. If such proceedings are not dismissed within fifteen (15) calendar days of their initiation, the Company reserves the right to terminate the customer’s access to the platform.

1.3. Violation of Ad Network Terms

Customers are required to adhere to the terms and conditions set forth by the relevant Ad Networks (e.g., Google Ads, Facebook Ads, etc.). If the customer breaches these terms, or if the Ad Network requests the Company in writing to cease providing services to the customer, the Company will comply, and the customer’s access may be immediately suspended or terminated.

2. Consequences of Termination or Expiration

Upon termination or expiration of the service agreement for any reason, the following consequences will apply:


Access Revocation: The customer and any additional users associated with the account will lose access to the Company’s services and platform immediately. This includes any clients the customer may have linked to the platform.

Removal of Content: The Company reserves the right to review and remove any content uploaded by the customer to ensure compliance with the terms. If content is found to be in violation, it may be removed without prior notice. Furthermore, the Company may choose to terminate the customer’s account temporarily or permanently based on the severity of the violation.

Refund of Fees: If the Company terminates the customer’s right to use the service due to reasons not caused by a breach of terms, the customer will be eligible for a pro-rated refund for any services that were paid for but not delivered.

3. Refund Policy
3.1. Refund Eligibility

Upon cancellation or termination of services, the following refund conditions apply:

Unspent Advertising Funds: If the customer terminates the service or if the Company discontinues the service for any reason, the customer will be entitled to receive a refund for any unused advertising funds that have not yet been spent on the Ad Network. The refund will be calculated based on the actual unspent balance at the time of cancellation.

Service Fees: The service fees charged by the Company for managing the customer’s Ad Account are non-refundable. If an advertisement has already been published or the service has been rendered, no refunds will be provided for the Company’s fees, regardless of the performance or effectiveness of the ad campaign. This ensures that the Company is compensated for the work and expertise invested in managing and launching campaigns.

Refund Timeline: Refunds will be processed within 15 business days of the cancellation or termination request, provided all conditions for eligibility are met. The refund will be issued via the same payment method used by the customer for the original transaction unless otherwise agreed upon.

3.2. Exclusions

The following are instances where a refund will not be provided:

If the customer breaches the terms and conditions set forth by the Company or the relevant Ad Network, leading to the termination of the service.

For any service fees incurred for the management, strategy, and optimization of the advertising campaigns, once the service has been rendered, even if the campaign’s objectives have not been met.

If the advertising budget has already been spent in full or in part by the time of cancellation or termination.

4. Discretionary Termination

While the Company maintains the right to suspend or terminate accounts at its discretion, the Company is not obligated to do so based on minor violations. However, in cases of significant violations or repeated breaches, the Company will take appropriate action, which may include account termination, suspension of services, or denial of future service requests. In such cases, a customer may or may not be eligible for a refund, depending on the circumstances of the breach and the specific details of the service agreement.

5. Final Provisions

This policy is subject to modification at any time at the Company’s discretion. If changes are made, customers will be notified via email or through an update on the platform. By continuing to use the services after such changes have been posted, customers accept the revised terms of the Refund & Cancellation Policy. Customers who do not agree with the changes must notify the Company immediately and cease using the service.
